AUCKLAND CITY HARBOUR NEWS, MAY 31, 2013
Auckland Council District Plan
Proposed plan modifications 67 (Central), 56 and Variation 11 (HGI), 339 (Isthmus),
43 (WCC), 40 (NSCC) and 59 (MCC)
Auckland Council has resolved to notify the plan
modifications to sections of the Auckland Council District
Plan (District Plan) identified above under the Resource
Management Act 1991 (RMA).
The proposed plan modifications seek to add, remove and
alter the volcanic viewshafts and associated objectives,
policies and rules around the region to align the various
sections of the District Plan with the Auckland Council
Regional Policy Statement.
Places to view the plan modification
The proposed plan modifications and background
information may be viewed free of charge at
during business hours at:
• your public library
• the nearest service centre
• your local board office.
Please phone Auckland Council on 09 301 0101 if you have
any questions about the proposal.
The following persons may make a submission on the plan
• the local authority in its own area
• any other person, but if the person could gain an advantage
in trade competition through the submission, then the
person may do so only if the person is directly affected
by an effect of the proposal that adversely affects the
environment and does not relate to trade competition or
the effects of trade competition.
You may make a submission by sending a written or

• lodge your submission at your local library, service centre
or local board office.
Your submission must be in the format outlined in
the RMA - Regulations, Form 5. You can print
submission forms that follow this format from
www.aucklandcouncil.govt.nz/districtregionalplans or get
them from the places listed previously.
Submissions close on 1 July 2013.
The process for public participation in the consideration of a
proposed plan modification under the RMA is as follows:
• after the closing date for submission, the council must
prepare a summary of decisions requested by submitters
and give public notice of the availability of this summary
and where the summary and submissions can be inspected
• there must be an opportunity to make further submissions
in support of, or in opposition to, the submissions already
- any person representing a relevant aspect of the public
- any person who has an interest in the proposal greater
than the general public has
- the local authority itself.
• if a person making a submission asks to be heard in
support of his or her submission, a hearing must be held
• the council must give its decision on the provisions and
matters raised in the submissions (including its reasons for
accepting or rejecting submissions) and give public notice
of its decision within 2 years of notifying the proposal and
serve it on every person who made a submission at the

appeal the decision on the proposed plan modification to
the Environment Court if:
- in relation to a provision or matter that is the subject
of the appeal, the person referred to the provision or
matter in the person's submission on the proposal
- in the case of a proposal that is a proposed policy

withdrawal of the proposal as a whole.

These conditions apply to all advertising
in this publication unless we have agreed
other terms in writing with the advertiser
1. In accepting an advertisement for
publication and in publishing it we are
doing so in consideration of and in reliance
on your express warranty, the truth of
which is essential:
a. That the advertisement does not contain
anything that: (i) is misleading deceptive
or likely to mislead or deceive or which
otherwise breaches the Fair Trading
Act 1986; (ii) is defamatory, indecent
or which otherwise offends against
generally accepted community standards;
(iii) infringes copyright, a trademark or
otherwise infringes any intellectual or
industrial property rights; (iv) breaches any
provision of any statute, regulation, by-law
or other rule of law; and
b. That the advertisement complies in
every way with the Advertising Codes
of Practice issued by the Advertising
Standards Authority and with all other
standards relating to advertising in New

give rise to liability on our part, or in a claim

4. Where the advertiser uses our creative
services in the design or production of an
advertisement (including photographic or
design work) you acknowledge we own
the copyright in such work and that such
work is not work for which a commissioning
payment has been agreed.
5. We may amend advertisements for style
or other genuine reasons using reasonable
care, refuse to publish without reason, and
may publish on the next available day if
there is an error or delay in publication of
the ad as booked.
6. We may take orders for specific spaces
(space orders). The space may only be
used by you for advertising your usual
business and may not be transferred by
you to another person.
7. The guarantees contained in the
Consumer Guarantees Act 1993 are
excluded where you acquire goods or
services from us for the purpose of a

if there is an error or omission in any
advertisment. We will not be liable for
any indirect or consequential loss, (which
includes loss of revenue or profit) from
any error, or omission or failure to publish.
If we are found to have any direct liability,

up to 28 days after an adjustment. Space
order rates are not reduced if the space is
not used. To cancel an ad a cancellation
number must be obtained.
12. GST will be added to all advertising
except for non-NZ based clients. Payment
is due seven days after the invoice date
unless otherwise authorised. In the event
of late payment the advertiser will be liable
for market rate interest and all collection
13. All casual advertising must be prepaid
prior to publication. Payment by credit card
for casual advertising is accepted.
14. We may provide guidelines to be
followed where you include internet
addresses in advertising.
